Event in the “Privacy Above All” series: LGPD and CDC

Summary

Never before has our data been so exposed. The pandemic has brought with it a considerable increase in the need for alternatives to protect consumer data. On the one hand, we have actions to protect against data leaks; on the other, the question of how to make the virtual environment safer without harming the consumer experience.

 

The theme chosen for the latest Privacy Tools event was another in the series: “Privacy above all: LGPD and CDC,” which took place on October 14th and featured the participation of Carolina D'ávila (PrivacyTools and FreireSaraiva), Diógenes Carvalho (SENACON), Marcelo Crespo (Privacy Rocket), and Rodrigo Suzuki (Logicalis).

DATA BREACH: WHO TO CONTACT?

 

Carolina begins the conversation by addressing the sensitive topic on the agenda: dealing with issues from the perspective of consumers who feel they have been harmed by inadequate data handling during a consumer relationship.

 

The pandemic brought about a change in consumer behavior, initially forcing people to migrate online. This exponentially increased e-commerce purchases, representing a challenge for both the National Consumer Secretariat and the sector's regulatory agencies.

 

Diógenes then explained that SENACON, even before the emergence of the LGPD (General Data Protection Law), was already carrying out inspection work, sanctioning companies in cases of data leaks that harmed consumers. He reiterated that the applications of the LGPD do not replace the application of sanctions that are in the consumer protection code and finally advised on how the injured consumer can proceed.

 

Consumer Protection vs. Comfort

 

Carolina then questions how data security can be improved on e-commerce platforms without compromising the customer experience during the purchase process.

 

Rodrigo Suzuki then responds, "Security is one path, comfort and convenience are another." He goes on to explain that it's necessary to find a middle ground between making the environment safe for the owner without forgetting their comfort when accessing that environment.

 

The challenge is to prioritize security without neglecting usability and consumer comfort. Rodrigo emphasizes that companies need to monitor and protect themselves from emerging threats, not only fraud but also data leaks.

 

He points out how the ease of creating user passwords or the constant repetition of the same passwords can favor hackers, and adds: "The fraudster has a very large arsenal to compromise the user's life. For this reason, the implementation of technical controls is a way to thoroughly filter out the major threats."

 

DATA PROTECTION ON BLACK FRIDAY: HOW TO PROCEED?

 

Last year alone, the São Paulo consumer protection agency (Procon) registered an increase of over 60% in complaints related to Black Friday. During this period, there is a considerable increase in the receipt of advertisements and the use of data such as emails and phone numbers to send promotions on platforms with which the user has often never established a purchase agreement or interest.

 

Diogenes warns users to be careful, especially at this time of year with unusual promotions, links to suspicious websites, providing data to unknown stores, and promotions posted on social media.

 

Marcelo discusses the need for consumers to pay attention to the price history of a desired product before Black Friday deals. He also mentions that no matter how much of a discount a product may have, there's no magic involved, and finally highlights the roles of the LGPD (Brazilian General Data Protection Law) and the CDC (Brazilian Consumer Protection Code) during this time of year.
