Much has been said about data protection issues, the LGPD (Brazilian General Data Protection Law), and the necessary adaptation to the new law. We know that when it comes to football clubs, we are talking about institutions that handle a very large quantity and variety of data.
And that was the topic of the latest Privacy Tools event in the “Privacy Above All” series: LGPD and Football – The Defense, which drew this parallel between the adequacy of LGPD with regard to the movement of data that Football Clubs and the company itself CBF They need to deal with it. LGPD in football clubs
Alexandre Pinto begins the conversation by talking about the adaptation process and the importance for clubs to adapt to... LGPD.
He says he believes all areas need to be properly integrated and that this alignment helps the organization gain more competitiveness and maintain a good reputation, since one of the worst things for any company is facing problems due to a lack of privacy. He emphasizes: “…If you have a privacy issue, it’s not good for the reputation of any company, any club, any organization.”
Aline asks Elaine how the CBF Elaine has been involved in structuring processes and systems such as BID (Brazilian Football Confederation's player registration system) and how data from athletes and coaching staff is handled. She then discusses the role of the CBF (Brazilian Football Confederation) as a global benchmark and talks about how the organization has positioned itself regarding this structuring.
Consent: how to proceed?
Alexandre talks about the difficulty of the issue of consent in data usage and how expensive it becomes to keep track of this issue.
He says: ""Consent is increasingly becoming more expensive and much more difficult to manage. Consent is valid only until the data subject decides otherwise, so they can give consent today and withdraw it tomorrow. In the case of sports, which is highly emotional, you might be satisfied today and not tomorrow, simply because your team wins or loses a match."
LGPD: a challenge for football
When it comes to consent and biometrics in relation to football clubs, the issue is indeed more complex.
Clubs need to find a way to make this selection from data of minors in youth academies, players from official teams, club members, visitors, and merchants, while also handling consent and biometrics even with events of 30 or 40 people, in a way that doesn't make the fan experience bureaucratic and tedious by including numerous processes.
And that is the challenge. "Biometrics necessarily raises the issue of security; it's a reality, and we have to face it, adapt to the legal provisions, and make these two issues interact." Guilherme concludes.
