First event of the year in the “Privacy Above All” series: LGPD and the Metaverse

Summary

Privacy Tools held its first free online event of the year. The topic of the discussion was the Metaverse, in relation to the data privacy landscape.

The event took place on the 27th, and featured Aline Deparis from Privacy Tools leading the conversation, with special guests including: Caroline Teófilo from Peck Advogados, Bruno Feigelson from Wal, and Wellington Monaco from Monaco.

The event also included a lecture on Metaverse and privacyFeaturing Wellington Monaco, in addition to raffles during the event.

The event began with Wellington Monaco speaking about... Resolution CD/ANPD No. 1 and on the Metaverse.

Next, Aline began the question and answer session, asking Caroline whether she believed that legislation would be created for the Metaverse or if it would be possible to use existing frameworks to create legislation that could be applied in that scenario.

Caroline then says that the situation is still very uncertain, and that as far as... Metaverse universeIt is still difficult to predict.

“Issues such as information security, regulation itself, the role of the State in these environments, intellectual property, digital crimes, and privacy itself—they exist, and we don't know how this evolution will unfold within the metaverse. Any company can create its own world in the metaverse; there are no physical limitations. So we don't know if there will be a judiciary or police power there.”, says Caroline.

 

Public rights and the Metaverse

Aline continues the conversation by asking Bruno about the possibility of there being a way to preserve the consumer rights, And he explains that, with this decentralized scenario, it becomes difficult to enforce rights: "So the consumer issue is much more about who is on the passive side? When we talk about decentralized data in the Web 3.0, how do I ask, for example, to anonymize my data, who do I ask? What do I demand?" He questions it.

Aline then asks Wellington: "Generally, if we observe, to use the services offered by websites and applications, people obviously agree to the terms of use, and inevitably, or in the vast majority of cases, end up not even reading the privacy notices and terms of use. If today, when we know that there is still this marked division between the real and the virtual, data leaks and misuse are already very frequent, what can we expect regarding the expansion of access to the Metaverse, and how can the SGPD (Brazilian General Data Protection Law) support this, in your perception, Wellington?"

He then says that the biggest concern is that People, in general, accept terms without knowing what they mean, and this represents a risk for those people.

“The concept of an asset has been lost; people still don't understand what a digital asset is. So, that's the big concern. When I go to a website and sign up without reading the terms or conditions, and there are many cases where people are contracting cloud platforms, especially in the context of crypto assets, you have a very strong scenario of information theft. So the amount of leaks and Bitcoin theft that is happening is absurd. It's billions of dollars.” That's all, Wellington.
