Serasa is a company that has been in the market for 45 years and became part of the Experian Group in 2007. The organization gathers people's financial data to support businesses, mainly credit granting services.
PFor example, if a consumer has a "bad credit history," it means they owe money to some institution. Therefore, this makes it difficult for them to access loans and financing.
In this case, when gathering important information about Brazilians, some privacy precautions must be considered. With the validation of the General Data Protection Law in 2020, many began to observe the possible consequences of exposing credit scores. This score shows someone's ability to make payments or not.
The score ends up becoming visible.
The establishment of any debt is visible to everyone on the Serasa Experian Portal. However, a large part of the complaints to the Court of Justice of São Paulo involving the LGPD (Brazilian General Data Protection Law) represent this situation. Allegations of irresponsibility in SPC's support have divided opinions, but it is important to discuss the advancements in the right to privacy.
In a period of one year, numerous cases appeared in the TJ-SP (Court of Justice of São Paulo), thus, one of the cases (1002747-34.2021.8.26.0077) It involved a woman claiming she had been harmed after her information was not updated in the SERASA database after she paid off her debts. Her main complaint was the difficulty in obtaining credit even with a clean record.
In the ruling, the 38th Chamber of Private Law decided not to grant the appeal because no denial linked to the release of any benefit was identified; therefore, the problem mentioned was not found to be true.
According to the rapporteur, Judge Flávio Cunha da Silva, the user's registration in "Serasa Limpa Nome" was restricted to creditor companies and those in which she had allowed profile consultation, but this did not directly impact her credit score.
Lack of privacy leads to embarrassment.
However, according to Judge Anna Paula Dias da Costa, the information could indeed be accessed by third parties using the applicant's CPF (Brazilian taxpayer ID) and name, and she stated that the incident caused embarrassment.
According to data security legislation, if the disclosure of certain information without consent causes distress or fear for any reason, it should be handled with care.
