Summary

Elections are approaching, and along with them come several issues that should be carefully considered regarding the privacy of our data during this period, which is known to be a time when we culturally tend to have our data used more for political propaganda purposes.

On the 25th, the Privacy Tools promoted another free online event in which the important role of was discussed. General Law of Data Protection No. election period.

The event, led by Aline Deparis, featured Giuseppe Janino from Digital Election Consulting, Davis Alves from ANPPD, and Larissa Ordoñez from the Kantar Group, an expert who opened the event with a presentation on the topic.

The event began with a round of presentations by the invited professionals, followed by a lecture by Larissa on data privacy during the election period.

“Another resolution is the 2021 resolution, which slightly altered the previous one. Here, we see a greater concern with the General Data Protection Law in the electoral context, which mandates that parties and candidates define communication channels and appoint data protection officers.”"says Larissa."

Larissa follows the theme and arrives at the question of consent: “…Consent is super important, so regarding advertising, they have to have our consent, even to send these advertisements via WhatsApp, through mailing lists, so this information must be handled through consent forms.” 

Aline then continues the conversation by asking Giuseppe about the actions and changes that have been observed in the relationship between the LGPD (Brazilian General Data Protection Law) and political-partisan issues.

Giuseppe then says that the irregular treatment of personal dataparticularly sensitive issues can result in a negative impact that undermines the integrity of the process. electoral process and also equal opportunities for all candidates.

"Brazil is the fourth largest democracy in the world and is holding the largest digital election on the planet. We are exactly 38 days away from the 2022 general elections, with a total of more than 28 candidates and 33 political parties participating in the election," "...We are now moving from a paradigm, let's say, of a lawless land, to a scenario where there are effective protections and guarantees for the Brazilian citizen, and these rules are defined through the LGPD (Brazilian General Data Protection Law), through the resolutions of the Superior Electoral Court..." Giuseppe discusses the topic.

"The big question is how this will actually be implemented, but the expectation is that there will be effective requirements and guarantees, precisely and primarily for the citizen.""That's all," Giuseppe concludes. 

LGPD, elections, and fake news

The conversation then continues with Aline questioning Davis: "How has the issue of jurisdiction and, above all, cooperation between the electoral justice system and our National Data Protection Authority been developing, and what mechanisms could actually be applied in this case?"

Davis then replies: "The ANPD has already given us, and the entire Brazilian population, a gift: a guide on the protection of personal data. Now, in the electoral process, they have provided an Orientation Guide for the Application of the General Data Protection Law by data processing agents in the electoral context."

"The LGPD (Brazilian General Data Protection Law) has several gaps regarding how data protection will be carried out by the public sector. It is a law very focused on the population, very focused on the data subject themselves, but there are several points that need to be addressed by the sector."

Aline then continues the conversation by asking Larissa how the LGPD (Brazilian General Data Protection Law) could effectively help in... combating fake news

Larissa then says: "Regarding fake news, I think it depends directly on how it circulates in the digital environment, there's Instagram, Facebook, WhatsApp itself. What happens, how could the General Data Protection Law help... I think, unfortunately, the General Data Protection Law deals with data and information but fails to address fake news."

"Fake news is fake news, right?! Anyone can create fake news, the problem is, unfortunately, the law deals with personal data, it doesn't deal with false information.""That's all," Larissa concludes.
