Summary

The Internet of Things (IoT) is becoming an important part of everyday life, enabling the integration of internet-connected devices. In this way, it provides automation, remote control, and data collection to improve efficiency and convenience. However, as the number of IoT devices increases and they begin collecting user data to facilitate their operations, privacy and security become fundamental concerns.

In this context, the LGPD (Brazilian General Data Protection Law) plays an essential role in regulating the use of personal data and guaranteeing user privacy.

In this article, we will explore the impacts of the LGPD (Brazilian General Data Protection Law) and the challenges of the Internet of Things (IoT) and how it is shaping this constantly evolving scenario.

Internet of Things (IoT)

Internet of Things (IoT) is a title coined by Kevin Ashton for a project presentation to executives at Procter & Gamble (P&G).

The Internet of Things is the term used to describe the hardware and software infrastructure that enables the connection between various smart devices. Its concept is based on the merging of the real world with the virtual world.

Furthermore, IoT has the potential to be applied to various niches, with Smart Homes being particularly noteworthy. In this sense, devices collect data by applying artificial intelligence algorithms and cross-referencing information through Machine Learning. This results in the generation of statistics to detect relevant patterns and behaviors.

Data Generation in IoT

With the Internet of Things, a multitude of smart devices are collecting and processing a vast amount of data from different users, such as location information, personal preferences, and even biometric data.

Given this, the LGPD (Brazilian General Data Protection Law) establishes guidelines to ensure that this data is handled securely, adopting appropriate measures to protect it against unauthorized access. Therefore, the responsibility falls on both IoT device manufacturers and companies that use this data, requiring them to comply with the LGPD.

It is unfeasible to maintain databases without precise knowledge of their origin. Furthermore, companies in this situation will be obligated to make changes in accordance with the law.

IoT Challenges in the Context of the LGPD (Brazilian General Data Protection Law)

The combination of IoT with the LGPD (Brazilian General Data Protection Law) raises complex issues related to privacy, security, and the proper handling of personal data.

Issues such as data leaks, information security, insufficient information, and difficulty in obtaining user consent are just some of the challenges related to the processing of personal data.

As the IoT continues to develop, working together to address these challenges is essential. Ensuring security and respecting user rights, privacy, and the protection of personal data must remain central to efforts to unlock the full potential of the Internet of Things within a legal and ethical environment.
