Bill 5762/2019, authored by Congressman Carlos Bezerra (MDB-MT), has only a 0,2% chance of approval. This projection was given by the tool used to calculate the... The probability of a project being approved by the House or Senate, the Approval Meter, developed by JOT.
The project.
The objective of the Bill is to postpone the start of the LGPD's (Brazilian General Data Protection Law) enforcement until August 2022. The law, sanctioned in 2018 and scheduled to come into effect in August of this year, justifies this postponement by the congressman by stating that a large portion of the country's companies are not prepared to meet the criteria established by the new law. The congressman also cites the government's delay in establishing the National Data Protection Authority (ANPD).
However, approval of the bill does not seem likely. Representative Eduardo Bismarck (PDT-CE), rapporteur for the bill in the Constitution and Justice Committee (CCJ), says his opinion will likely be against extending the law's validity period. According to him, as long as it is established that sanctions will only occur when the structure is capable of applying them, it is indeed possible to implement the law while the ANPD (National Data Protection Authority) is being established.
The National Data Protection Authority.
The federal agency, created with the 13.853 Law, will be responsible for issuing regulations and overseeing procedures regarding the protection of personal data. The organ It will still have the power to apply sanctions in cases of irregular data processing, such as fines and warnings.
As foreseen in current legislation, the ANPD (National Data Protection Authority) can coordinate with other sanctioning bodies to enforce the provisions of the law. It will also have a National Council for the Protection of Personal Data and Privacy, composed of 23 representatives, both full and alternate members, from public bodies and civil society.
