Summary

The General Data Protection Law (LGPD) is already in effect and must be followed by all institutions that collect and process personal information. The law applies to small, medium, and large companies, as well as public bodies.

 

The latest online event from Privacy Tools addressed the application of the new law within the government sphere. It was held via YouTube on July 29th and featured the following guests: Ademir Piccoli (Exponential Judiciary), Mauro Sobrinho (Ministry of Economy), Miriam Wimmer (ANPD)The chat was led by the CEO of Privacy Tools, Aline Deparis.

1 - Courts are prioritizing the relationship with data.

 

According to Ademir Piccoli, the number one priority for the courts currently is information security, and the number two priority is compliance with the LGPD (Brazilian General Data Protection Law). The higher courts have suffered many cyberattacks, hence the concern. "It's necessary to have a strategy for each of them," he pointed out.

 

Each court needs to create its own CGPD, an acronym for Data Protection Management Committee. "All contracts and agreements must be reviewed to ensure compliance with the LGPD," explained Piccoli.

 

2 - The government is already undergoing digital transformation.

 

Mauro Sobrinho began his speech by pointing out that the federal government is already quite digitized, facilitating various services for citizens. "However, the more digitized it is, the larger the attack surface," he cautioned.

 

According to Sobrinho, “digitalization is the way forward, but it must be accompanied by a series of precautions, such as the issue of data protection.” Artificial intelligence is already being used by the government. “Twenty years ago, the concern was the efficiency of the algorithm,” he recalled. Nowadays, the concern with data protection and privacy is greater. “Before, everything was collected, then they saw what to do with the data. Today it's no longer like that,” he observed.

 

3 – The challenge is applying the LGPD (Brazilian General Data Protection Law) in different realities.

 

Miriam Wimmer highlighted during her speech that one of the main challenges Brazil faces in data protection is applying the law in such different realities. There are 27 federative units, each with its own reality regarding technology and data protection.

 

“Any compliance project must necessarily consider the reality of that organization, whether it is a large or small company, or a public entity,” she commented. Miriam highlighted that the ANPD has a FAQ on its website, clarifying the main doubts, and has prepared a guidance guide.

 

She notes that the biggest doubts from public authorities regarding the LGPD (Brazilian General Data Protection Law) concern the roles of the operator, controller, and data protection officer, as this is a reality distinct from that of private companies.

 

4 – Education is the beginning of the journey.

 

Piccoli emphasized that "there's no way to start the journey without education." According to him, it's necessary to provide training. In the public sector, it's essential to guide all employees so they understand the importance of data protection and implement a culture of privacy in government agencies.
